Quick answer: What startups need to know about Pennsylvania employment law. Final pay, minimum wage, workers comp, and more for Pennsylvania employers.
At-Will Employment
Pennsylvania is an at-will employment state. Employers may terminate employees for any lawful reason. Pennsylvania recognizes a public policy exception.
Final Pay
Pennsylvania requires final pay for involuntary terminations by the next regular payday. For voluntary resignations, final pay is due by the next regular payday. If the payday is more than 30 days away, payment is due within 30 days.
Minimum Wage
Pennsylvania's minimum wage is tied to the federal minimum wage of $7.25/hour. Pennsylvania has not enacted a higher state minimum wage.
Workers Compensation
Pennsylvania requires all employers with 1 or more employees to carry workers compensation. This is mandatory from the first employee. Agricultural workers working fewer than 30 days or earning less than $1,200 per year are exempt.
