North Carolina HR Compliance for Startups

Quick answer: What startups need to know about North Carolina employment law. Final pay, minimum wage, workers comp, and more for North Carolina employers.
At-Will Employment
North Carolina is a strong at-will state. Either party may end the employment relationship at any time, for any reason that does not violate public policy or anti-discrimination laws. NC has no law requiring advance notice of termination.
Final Pay
The North Carolina Wage and Hour Act (NCWHA) requires employers to pay final wages by the next regular payday following separation. NC is different from California - there is no immediate final pay requirement. However, late payment can trigger penalties and interest.
PTO and Vacation Payout
North Carolina does not require employers to provide vacation or PTO. However, if a written policy promises PTO payout at termination, the NCWHA treats that promise as legally binding. Review your handbook language carefully - vague PTO payout terms have created employer liability in NC.
Minimum Wage
North Carolina's minimum wage follows the federal minimum of $7.25/hour. NC has not enacted a higher state minimum wage. Employees earning tips may be paid a lower tip credit rate if tips bring total compensation to at least $7.25/hour.
Workers Compensation
Employers with 3 or more employees must provide workers compensation coverage in North Carolina. This is a common area where small startups get caught - the threshold of 3 employees is lower than many other states.
New Hire Reporting
North Carolina employers must report all new hires to the NC State Directory of New Hires (ncdhhs.gov) within 20 days of hire. Report via online portal or paper form.
E-Verify
North Carolina law requires employers with 25 or more employees to use E-Verify for all new hires. Smaller employers are not required but may use it voluntarily. This requirement is stricter than federal law.
Required Postings
NC employers must display federal workplace posters plus NC-specific posters covering workers comp, NCWHA wage and hour, NC EEO notice, and unemployment insurance. The NC DOL provides required posters at labor.nc.gov.
