Quick answer: What startups need to know about Georgia employment law. Final pay, minimum wage, workers comp, and more for Georgia employers.
At-Will Employment
Georgia is an at-will employment state. Employers may terminate employees for any lawful reason without advance notice or severance. Georgia has limited exceptions to at-will employment.
Final Pay
Georgia does not have a specific state law governing final pay timing. Best practice is to issue final pay on the next regular payday. Federal FLSA requires timely payment of all earned wages.
Minimum Wage
Georgia's state minimum wage is below the federal rate, so the federal minimum wage of $7.25/hour applies to most employers covered by the FLSA. Some employers not covered by FLSA may pay the lower state rate.
Workers Compensation
Georgia requires employers with 3 or more employees to carry workers compensation. All construction businesses with 1 or more employees must carry coverage, regardless of size. Sole proprietors and partners are excluded but may elect coverage.
New Hire Reporting
Georgia employers must report new hires to the Georgia New Hire Reporting Center within 10 days of hire. This is a shorter deadline than the federal standard.
